November 12 became December 11
Congress rewrote the federal definition of hemp in late 2025. The new definition measures total THC — which includes THCA — instead of delta-9 THC alone, and it caps finished hemp products at 0.4 milligrams of total THC per container. It was scheduled to take effect November 12, 2026.
On September 2, 2026, the stopgap funding bill H.R. 6500 pushed most of those restrictions to December 11, 2026. Products containing cannabinoids the plant cannot make on its own still lose federal hemp status on November 12. Natural THCA flower falls under the December 11 date.
What Wisconsin law says
Wisconsin’s own hemp statute still measures delta-9 THC only, up to 0.3 percent on a dry-weight basis. The Wisconsin Legislative Council has noted that this creates a gap: a product can be hemp under state law and still fall outside the new federal definition.
